Wharf Rules

General rules for the use of wharves, berths, jetties, ramps and land under the control/ownership of FNHL

The following is a summary of the Kororāreka Russell Wharf Rules. A full copy is available from the offices of FNHL or from the Maritime Manager.

It is the users’ responsibility to be aware of all Wharf Rules.

Berthage

Provision of any berthage is at the sole discretion of FNHL or its Agent. Availability of appropriate berthage is variable and dependant on vessel size and weight. Long stays are not available; the wharf is not a marina.

Fees

Recreational Berthage – Levied directly to any vessels skipper or owner who berths the vessel temporarily or overnight. Fees are payable at either the Information Kiosk or directly to the Kororareka/Russell Community Wharf Kaitiaki Trust (KRCWKT).

Recreational Users

Load and/or unload only – with maximum stay 30 minutes in any 4-hour period free of charge. A longer stay will require a fee being paid to the Kororareka/Russell Community Wharf Kaitiaki Trust (see notice boards) Overnight berthage – available on request. Bookings/enquires at Wharf information Kiosk.

Commercial/Charter Operators

Annual Facility Fee provides for – Load and/or unload only – with maximum stay 30 minutes in any 4-hour period. A longer stay will require a fee being paid to FNHL or the KRCWKT (see notice boards).

Overnight berthage – may be available on request. Bookings/enquires at Wharf information Kiosk.

Annual Facility Fee payable to FNHL.

Must provide vessel information to FNHL (or agent) including skipper details and mailing addresses.

Annual Facility Fee – Levied to all commercial, charter and tourist vessels operating from the wharf. Fee is based on MNZ surveyed passenger loadings. Full details of these fees are available from Far North Holdings Ltd, PO Box 7, Opua. Ph. 09 4025659 or the Russell Information Kiosk.

No Discharge

No vessel shall discharge to the marine environment any contaminated water, bilge water, oil, diesel, or sewage, treated or otherwise.

No person shall:

  • leave a vessel unattended at any time (other than authorised by the Info Centre or FNHL).
  • swim in the water surrounding the wharf
  • act or operate a vessel so as to create a danger, obstruction or inconvenience to others
  • allow any effluent, rubbish or other pollutant to be placed on the structure or allow any such pollutants to enter the waters surrounding the structure
  • cause a nuisance on the wharf and/or create obstruction
  • climb on or about, or interfere with any FNHL property including entering any building without permission or legitimate reason.
  • display signage without permission of FNHL and/or KRCWKT
  • carry out any repair work to any vessel, at or on the wharf, unless granted permission by the Maritime Manager.
  • fillet fish and dispose of heads, frames or skins in to the water

Every person using the wharf:

  • does so at that person’s risk, FNHL or KRCWKT does not accept any responsibility or liability for loss or damage to property or person.
  • shall comply with all by-laws and statutory obligations as may apply to that person and the property of FNHL and any vessel being used by, or for which that person is responsible.
  • comply with all signage and Wharf Rules
  • comply with the directions of the Maritime Manager or agent

Where any person fails to comply with the Rules he/she shall:

  • Leave the wharf immediately on request by the Maritime Manager or agent
  • Remove any vessel for which that person is responsible on request by the Maritime Manager or agent.

FNHL or Agent shall have the power and entitlement to:

  • Board and inspect a vessel at any time for any reason and if necessary to break into a vessel for this purpose
  • Deny access to and use of the wharf to a person or vessel which has breached these rules
  • Change the level of a fee and amend the Rules when it considers it appropriate
  • Remove any vessel from the Wharf that fails to comply with the Rules at no cost to FNHL and FNHL or KRCWKT shall have no responsibility for any costs or damage occurring to the vessel.
  • Refuse any person access to the Wharf on the basis of security or safety
  • Allocate areas upon the wharf which are available for specific berthage.
  • Pursue recovery of costs, register liens over the vessel, take a claim against the vessel in the District Court or High Court.
